The committee on the records reported that the be approved with the exception noted in the judicial case and decision herein appended = The following minute was adopted (at the meeting in Pontiac in Sep last) as the judgement of presbytery on the appeal of Mrs L. Miller and the complaint of Mr. and Mrs. Miller, The appeal is taken from the judgement of session in relation to the third count on specification in the general charge of unchristian conduct made in the common fame against Mrs. L. Miller, which is in these words, viz. The presbytery sustained the appeal because they judged the evidence did not support the allegation. It appears that certain remarks were made to Mrs. Smith by Mrs. Miller, what were accompanied with a refusal to give the hands in ordinary salutation which remarks were not heard by any other person but which deeply pained Mrs. S., the Presby do not judge this to be slander which to be such must be words written or spoken n the hearing of others, then the person injured, what were the injurious expressions, was testified only by Mrs. L., the party injured. It does not appear that Mrs. S. took the puliminary steps with Mrs. Miller required in Matt 18: before process was commenced by session, the Presby judge that the session should have required the observance of the rule of Church in this case and that the complaint was not one which should have been received in the name of common fame, because it did not process all the characteristic features require by our book of Dis to render common fame, a competent accuser. but while the presbytery sustain the appeal of Mrs. Miller was not such under the circumstances as becometh a Christian and precisely such as Mrs S. in case of failing to do session should have endeavored to convict by private conference and mediation before being made a matter of judicial investigation. The Presbytery further judge that the requirement of a public confession from Mrs. Miller under the circumstances was not authorized by the evidence of guilt, nor the amost appropriate method to bring to repentance, admonition and rebuke, should have been resolved to before prescribing such a summary test. The Presby sympathize with the session in their case and efforts to enforce the discipline of the church, but recommend the observance and enforasmuch more strictly of the rule of Christ as proper and necessary for the adjustment of difference between members, and the removal of offences. The following minute was reported and adopted as judgement of Presbytery in the case of the complaint of Geo Causwell and others against the decision of the church of Wing Lake Viz. The Presbytery sustain the complaint as respect to the first specification, because they judge that the answer of Mr. Miller to the charge fully admits the fact of his having made injurious apertious of during and in an instrument of legal process, reflecting duly on the character of Mrs. E. Buel. However such a step might have been advised and judged necessary by legal counsel in making a making a defense in a civil suit, yet the uttering or causing to be written injurious words of a brother or sister in the church where the laws of Christ Matt 18: had not been previously observed especially before an unbelieving world and not in the process of church discipline is as much of a moral nature as in any other relation and therefore a legitimate matter of invesq by a court of conscience. The Presbytery sustain the complaint in respect of the 2nd specification, because the accused as it appears i evidence admitted the fact of the sale of his property to his son, with the understanding that it was his only to provide for some preform creditors and with the statement that he had not received ore for his land than enough to pay the creditors and what the law allowed him of personal property which fact is also confirmed by other testimony. The Presbytery thinks that the principles involved in this defense however commonly they may be received in society as just, Viz. that a man may dispose of his property, for the benefits of preferred creditors and for the reservation of what the laws of the state concede to himself of personal property, should not be sanctioned by Christian men and church courts. As to the 3rd specification, Presbytery do not sustain the charging this respect, because it is so vaguely expressed as to be incapable of being proved being an apparent unwillingness, a state of heart and feelings inferred rather than direct acts which latter are and of right, must be the only matter for judicial investigation and the only proper index to the state of mind and heart. The Presbytery therefore dismiss the case to the session without any censure upon that body with the hope that in the particular and prayerful pursuance of the rules of our discipline hey may be able to bring to repentance those who may have wrred and heal the difficulties which the Presby regret , should have distracted the church. The Presbytery also express their opinion that it is unexpedient and tends to evil to depart from the strict provisions of the form of good. Chefl. 9:4 and for session to invite a moderator, any minister not a member of the Presby or to admit as a corresponding members elders of other churches and ministers especially to act as council either for or against the prosecution in cases of discipline. Signed, Samuel N. Steele, Moderator.
